NOTICE OF INTENT TO

CONTINUE OPERATION

Notice is hereby given that the sand/gravel mining operation being conducted by Berkner Excavating & Gravel Inc., PO Box 87, Milbank, SD 57252-0087 will continue its mining operation located at NE1/4 Section 18; T121N-R47W, Grant County, SD.

The general location of the mining operation is 4 miles north, 2 miles east and 1/2 mile north of Milbank.

The operation originally advertised to be completed January 2, 2024, will be extended to January 2, 2034.

Proposed future use of the affected land will remain as originally advertised.
