The Town Board met in regular session on February 6th, 2023 at 6 p.m. at the town fire hall. President Frank Eccles present, members Kathleen Quale & Dale Bauer present. Others present were: Norma Arend – finance officer, Arlo Anderson, Calvin Pies, Don Richter, Travis Benthin, David Lewandowski, Ciera Schwinger, Jennica Pottebaum, Sandy Lowery, Connie Brotzel, Jim Thurman and Josh and Brittany Neuhard.             

Eccles called the meeting to order at 6 p.m. Public communications: None     

Motion by Quale, second by Eccles to approve the minutes, financial reports and claims as presented. Motion carried.  

Old Business:  Gonsalves legal update: None

Delinquent water bills were discussed.  

In regards to the possibility of a five member town board – the town board cannot change the number of members on the board.  Residents must turn in a petition with the required number of signatures to take the question to a vote.  

Motion by Quale, second by Bauer to approve the following resolution:

TOWN OF SUMMIT

RESOLUTION #2023-1  

WHEREAS, on February 6, 2023, the Town of Summit declared certain real property, described more fully below, to be surplus and no longer suitable for municipal purposes; and

WHEREAS, SDCL 9-27-36 allows the transfer of municipal property to a non-profit local industrial development corporation; and

WHEREAS, the SAEG is a South Dakota non-profit corporation formed to promote and encourage industrial and economic development within the Town of Summit; and

WHEREAS, the Town Council of Summit finds it to be in the best interests of the community to donate the property described below to SAEG, a South Dakota non-profit corporation, for economic development use associated the construction of a Truck/Car Wash.

NOW THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Summit that the following property shall be donated to SAEG, a South Dakota non-profit corporation of Summit, South Dakota:

Lot 1, Block 1, Summit Northside First Addition to the Town of Summit, Roberts County, South Dakota.

BE IT FURTHER RESOLVED, the Kathy Quale as a Trustee of the Town Council and the Town Finance Officer are authorized to execute a Quit Claim deed transferring the property as described above via a deed for the sum of $1.00 containing a reversionary clause, acceptable to the Town Attorney which requires the development of the above described real property as a Truck/Car Wash within 24 months from the date of said deed.

Eccles abstained from vote due to conflict of interest. Motion carried.

New Business: Brittany discussed with the board maintenance issues at the bar. Brittany will try to obtain quotes for fixing the various issues. 

Motion by Eccles, second by Quale to approve the following South Dakota retirement resolution: 

RESOLUTION 2023-2

The following RESOLUTION was introduced, and Frank Eccles moved its approval.

BE IT RESOLVED by the Town Board as follows; the Town of Summit will enter the South Dakota Retirement System on April 2023.

At which time all eligible Class A employees will participate.

No prior service will be paid, considered or included.

Not Applicable years of prior service will be purchased by

• One lump sum payment of $ Not Applicable

• Level monthly payments of $ Not Applicable over a 20 year period

Motion for adoption of the foregoing resolution was seconded by Kathleen Quale.

Upon a roll call vote being taken, the following voted

YES: Dale Bauer, Kathleen Quale and Frank Eccles.

NO: Zero

Whereupon said resolution was declared duly passed and adopted.

All aye. Motion carried. 

2023 water, sewer and garbage rates were discussed.  Motion by Eccles, second by Quale to raise water, sewer and garbage by a total of $4.00 per month for residents in city limits.  The rates for water, sewer and garbage outside of city limits will be same. Metered rates will remain the same. Motion carried.  The new rates will be effective March 1, 2023. All aye. Motion carried.   

The director of equalization notified Norma that the legislature changed the years for our current property tax discretionary formula.  The formula must be changed from five years to seven years.  Kathy will discuss with our attorney for discussion at our next meeting.  

Daycare report: Topics included fence damage, water heater and delinquent daycare accounts      

Maintenance report: Road grader maintenance issue, working on old gym for pinochle tournament. 

Hearing for the liquor license request by the SAEG for a pinochle tournament at the old gym on April 1 will be at the next meeting. 

The Town board has a vacancy for a three-year term (Pete’s term).   Petitions for vacancies must be turned in on or before February 24 by 5 p.m., 2023. Election would be April 11 if more than one petition is turned in.   

Motion by Eccles, second by Bauer to adjourn meeting. Motion carried. The next regular town board meeting will be Monday, March 6, 2023 at 7 p.m. at the town fire hall.
