RESOLUTION AND
ORDER VACATING ROADWAY
Petitioners, William O’Farrell, President of Circle WJ Ranch, Inc., Colin Chamley, and Brenda Chamley, of Osceola Township, Grant County, South Dakota, presented the following Resolution and Order and moved for its adoption:
WHEREAS, a Petition having been received asking that Osceola Township vacate a roadway described as:
That existing public right-of-way 
which includes the statutory right of 
way and any right of way acquired by 
Deed(s) is lying on the section line 
highway running north and south 
commonly known as 464th Avenue 
bordered by 142nd Street on the 
north and bordered by 143rd Street 
on the south; and bordered on the 
west by Section 4 Township 121 
North, Range 50 West, Grant County, 
South Dakota and bordered on the 
east by Section 3, Township 121 
North, Range 50 West, Grant County, 
South Dakota; and said road being 
approximately 66 feet in width and 
approximately ONE (1) mile in 
length;
and further said Petition being in proper form and executed by more than the required number of electors of Osceola Township; and further it having been determined that a vacation of said roadway will better serve the public convenience; and that this Petition having come on at a special meeting of the Board; and no one appearing in opposition thereto; and said Supervisors having considered said matter and being fully advised in the premises and considering its advisable to do so:
NOW, THEREFORE, BE IT 
RESOLVED, AND IT IS HEREBY 
ORDERED:
That existing public right-of-way 
which includes the statutory right of 
way and any right of way acquired by 
Deed(s) is lying on the section line 
highway running north and south 
commonly known as 464th Avenue 
bordered by 142nd Street on the 
north and bordered by 143rd Street 
on the south; and bordered on the
west by Section 4 Township 121 
North, Range 50 West, Grant County, 
South Dakota; and bordered on the 
east by Section 3, Township 121 
North, Range 50 West, Grant County, 
South Dakota; and said road being 
approximately 66 feet in width and 
approximately ONE (1) mile in 
length
be and the same is hereby declared to be vacated; and further that a copy of this Resolution and Order be spread in the minutes of the Osceola Township Board
IT IS FURTHER ORDERED that said Resolution shall be published in the official legal newspaper of the respective township once each week for two (2) consecutive weeks; and that after such publication, such roadway shall be, after a lapse of thirty (30) days after the last publication thereof, vacated without further proceedings unless appealed as provided by law; and that the Clerk herein is further ordered and directed to cause to be recorded a true and correct copy of this Resolution and Order in the office of the Register of Deeds in and for Grant County, South Dakota;
IT IS FURTHER ORDERED that any and all bridges, guard rails and culverts are hereby deemed to revert to (not) and become the personal property and possession of Osceola Township.
The Motion was made by Supervisor Tellus Waddell and seconded by Supervisor Roger Smith and upon roll call, the vote was as follows:

I, Darlene Thaden, being the duly elected, qualified and acting Clerk of the Board of Supervisors of Osceola Township, Grant County, South Dakota, do hereby certify that the foregoing is a true and correct copy of the Resolution on the action thereon by the Board of Supervisors of Osceola Township, Grant County, South Dakota, at the regular meeting of said Board, held on the 16 day of December, 2019, as the same appears and is now recorded in the minutes of the Clerk of the Board of said Osceola Township and that the same is a true and correct transcript thereof.
