PURSUANT TO DUE CALL AND NOTICE THEREOF, a regular meeting of the City Council was duly held at City Hall at 7:00 PM. The following members were present: Mayor Pat Raffety, Councilmen Joel Foster, Mike Hanson, Scott Hoeke, James Johnson and Josh Karels. Absent: Steve Wiener. Present from the staff: Attorney Mark Reedstrom, Boyd VanVooren, Cynthia Schumacher, Scott Meyer, Dick Poppen, Darin Thiele and Ron Krause. Public present: Holli Seehafer, Kathy Ward, Brandon Berens and Bob Hartman.
Mayor Raffety called the meeting to order, and the roll call was taken.
    No one spoke during the open session.
A motion was made and seconded to approve the minutes of the September 14, 2020 meeting. Motion carried 5-0.
A motion was made and seconded to approve the Consent Agenda. Motion carried 5-0.
Consent Agenda
1. Authorizes the Mayor to sign all airport related documents regarding AIP Grant #3-46-0034-017-2020 CARES Act, $20,000.
2. Appoint Jason Sackreiter to P&Z Commission, replacing Michael Cordingly, as full-time member October 2020 to December 2021.
3. Appoint Luis Jimenez De La Torre to the Park & Recreation Board, replacing Eval Marroquin, October 2020 to December 2023.
4. Extend the Leave of Absence for Ron VanHoorn to January 1, 2021.
5. Approve Resolution 10-12-20B Consolidated Board of Equalization.
RESOLUTION 10-12-20B
City of Milbank Combined Board of Equalization
WHEREAS, the City of Milbank Board of Equalization, Grant County, South Dakota, does desire to consolidate local board of equalization with the County Board of Equalization for 2020 tax year, payable 2021, as permitted in SDCL 10-11-68, and
WHEREAS the City of Milbank Board of Equalization also believes the consolidation of the two boards would promote efficiency and equity of the equalization procedures.
THEREFORE, BE IT RESOLVED that there be formed a Consolidated Board of Equalization in accordance with SDCL 10-11-68 for real property within the County of Grant.
BE IT FURTHER RESOLVED that the City of Milbank Board of Equalization will have a member sit on the Consolidated Board of Equalization as designated by SDCL 10-11-68.
BE IT FURTHER RESOLVED that the City of Milbank Board of Equalization will compensate any expenses for their member that is on the County Board of Equalization.

DEPARTMENT REPORTS
Water – No bids were received for the lease of the hay ground land, described as the SE ¼ NE ¼ Section 16, Township 120 North, Range 50 West of the 5th P.M., containing approximately 33 acres.  
Grant County Economic Development – No report.
Rubble Site – A contaminated soil sample was sent in for testing. Friest tree service hauling in large volumes of trees and shrubs.
Street – Councilman Hoeke read the monthly report. The school zone signs in the Koch School area have been removed. They have cleaned and repainted parking lines in the downtown city parking lots.
A motion was made and seconded to declare the following items surplus, appraise them and dispose of as required.  Motion carried 5-0. Mayor Raffety requested Councilmen Hanson, Johnson and Foster review the items and appraise them if over $500.

A motion was made and seconded to approve Resolution 10-12-20 – Stop & Yield Signs. Motion carried 5-0.
Resolution 10-12-20
A resolution to amend certain provisions of Table II of the Milbank Municipal Code regarding the location of stop or yield signs on streets and avenues.
THEREFORE, BE IT RESOLVED that Table II of the Milbank Municipal Code shall be amended to include the following:
Stop Intersections:
- East 5th Avenue and 9th Street, Eastbound
- East Summit Street and 9th Street, Eastbound
- East Park Avenue and 9th Street, Eastbound
BE IT FURTHER RESOLVED that appropriate traffic control signs shall be erected in accordance with the provisions of this resolution.

Baseball Complex – No report.
Park – Councilman Johnson gave the monthly report. The department is preparing the equipment and parks for the winter. All docks at Lake Farley have been removed.
Mayor Raffety stated the campsites at Lake Farley are laid out. Banner is working with the railroad on drainage.  
One bid was received for the one-year ground maintenance contract. A motion was made and seconded to approve the bid submitted by Kelly’s Kutters, LLC, $74,850. Motion carried 5-0.
Wastewater – Councilman Karels reported the plant is running good, flows are very low. The DENR inspection went well.  Annual main cleaning is expected to start October 19, 2020.  
Personnel – No report.
Attorney – No report.
Finance – A motion was made and seconded to approve the bills list, $344,396.21. Motion carried 5-0.

A motion was made and seconded to approve the September Treasurer’s report. Motion carried 5-0. 
A motion was made and seconded to approve the second reading of Ordinance 831 – 2020 Supplemental Budget.  Motion carried by roll call vote, 5-0.
A motion was made and seconded to authorize the Mayor to set up a fund through South Dakota Community Foundation. The fund would be created for donations to Unity Square or other city departments for long term needs. Motion carried 5-0.

Fire – Councilman Hanson stated the department visited the schools for fire prevention week.    
Planning & Zoning –A conditional use permit requested by J&J Land Sales for the construction of up to seven two-family dwelling units to be constructed in Valley View Addition was discussed.  The Commission approved the construction of three two-family dwelling units in Valley View Addition.

Be it resolved by the City Council of Milbank, South Dakota in regular meeting assembled that the Lots 1 & 2 Whetstone-Manor Addition in the NE1/4 of Section 7, T120N, R48W of the 5th P.M. in the City of Milbank, Grant County, South Dakota be approved this 12th day of October, 2020 in accordance with the provisions of SDCL 11-3 and all acts amendatory thereto.

Police – Councilman Hanson read the monthly report. The officers have completed several online training courses.
A motion was made and seconded to approve hiring Wes Bowsher as a police officer, 5-1, $18.73/hour, effective 10/13/20. Motion carried 5-0.
Councilman Hanson stated the use of the fire siren was discussed. Chief VanVooren will meet with Grant County and 911 dispatch in Watertown to discuss the option of only using the fire sirens between the hours of 6:00 am and 10:00 p.m. Hanson stated there is confusion among residents between the fire siren and the weather alert sirens.
A motion was made and seconded to go into Executive Session pursuant to SDCL 1-25-2(3). Motion carried 5-0. The Mayor called the Council out of Executive Session. No motions were made.
Adjourn – The next regular meeting will be November 9, 2020, at 7:00 PM.  A motion was made and seconded to adjourn. Motion carried 5-0.
