Brian and Paige Homan are requesting to rezone the following legal description: Farrell’s Subdivision lot two in section 18 Township 120 Range 48 from “CI” Commercial/Industrial to “A” Agricultural.
Chairman Mach opened the joint public hearing for Ordinance #2026-02 on behalf of the Board of County Commissioners. Planning Commission Chairman Leddy asked Todd Kays to provide an overview of Ordinance #2026-02.
Todd Kays explained the Homan’s would like to rezone their 2.7 acre Commercial/Industrial (C/I) lot to Agricultural. Kays explained the reason for the change in zoning is because the lot is better suited to Homan’s needs to build a home now with a possible future option to conditionally permit a home occupied business. Kays stated two uses are not allowed at the same time on a C/I lot and it would be allowed on an agricultural lot if properly permitted.
P & Z Officer Berkner stated the property is located directly behind KMSD radio station and is part of a large block of lots adjacent to US Highway 12 just south of Milbank that were all zoned C/I over 50 years ago.
Planning Commission Chairman Leddy asked the Homans if they had any additional comments. Brian Homan said they will be available for questions if needed. Leddy called three separate times for comments in favor and against the zoning ordinance. There were no comments. Planning Commission Chairman Leddy closed the public hearing. Grant County Commission Chairman Mach closed the public hearing.
Planning Commission Chairman Leddy invited both the Planning Commission and County Commission discussion for the original motion to rezone the property. No one had any comments. Leddy called for the Planning Commission vote to recommend the zoning change to the County Commission. Motion carried 7-0.
County Commission Chairman Mach asked Kays to read the ordinance by title, which if done fulfills the County Commission’s first reading requirement to change the zoning ordinance to match the request. Kays read Ordinance #2026-02 by title. Mach called for a motion to set September 22nd as the date for the County Commission to have its second reading of the rezoning ordinance. Motion by Tostenson and seconded by Stengel to accept the first reading of Ordinance #2026-02 and set the second reading of Ordinance #2026-02 for Tuesday, September 22, 2026, at the next Commissioner meeting.
