       December 30, 2020
The Grant County Commission met at 8 AM by telephonic conference with the public. Chairman Mach called the meeting to order. Roll call was answered by Commissioners Street, Buttke, Tostenson and Mach. Quorum present. Commissioner Stengel joined the meeting. Motion by Street and seconded by Buttke to approve the minutes of the December 15, 2020 meeting. Chairman Mach called for a roll call vote. Street aye, Buttke aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0. Minutes filed. Motion by Buttke and seconded by Street to approve the agenda as presented. Chairman Mach called for a roll call vote. Buttke aye, Street aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0.
Members of the public present were Jim DeVaal, John Madsen, Angela Beacom, Brett Dickerson, States Attorney Mark Reedstrom, District 4 State Senator John Wiik and joining the meeting telephonically was District 4 State Representative Fred Deutsch.
The Chairman called for public comment. No member of the public addressed the Commission.
4-H: Advisor Sara Koepke provided an update on the construction plans for the exhibit building and the verbal financial commitments. The electrical plans from Holton Engineering will be sent to Whetstone Valley Electric to obtain a heating and cooling estimate for the completed constructed building.
2020 Year End: The Commission reviewed the year end financials. The following motions were made.
Contingency: Motion by Buttke and seconded by Stengel to approve the following year-end contingency transfers. Chairman Mach called for a roll call vote. Buttke aye, Street aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0.

Capital Outlay Designation: Motion by Tostenson and seconded by Stengel to approve the following list of capital designations for YE 2020 within the General Fund with an additional $50,000 added to the building designation and $500,000 added to the Highway projects designation. 4-H Building Project: Motion by Buttke and seconded by Stengel to approve a capital designation within the General Fund of $200,000 for the purpose of the 4-H Exhibit Building. Chairman Mach called for a roll call vote. Buttke aye, Street aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0.

Supplement: Motion by Tostenson and seconded by Stengel to approve automatic supplement of revenue and expense in the amount $3,845.06 for reimbursement of General Election expenses related to COVID from the Secretary of State Office. Chairman Mach called for a roll call vote. Street aye, Buttke aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0.
Drainage: The Commission, States Attorney, Senator Wiik and Representative Deutsch held a discussion on drainage and the state laws governing the drainage board. The items of discussion included the measurable items listed in statute the drainage board needs to follow, how the ordinance mirrors the state laws, the mediation of a drainage issue is to be handled by the board, the liability exposure for the County, personal liability of the board, drainage encompasses more than tiling, the state law states the county “may” form a drainage board, and the maximum $100 fee does not offset the insurance deductible of $5,000. Senator Wiik talked about the legislation of establishing watershed districts he had sponsored in a prior session and how it did not pass because support of changing drainage laws is not a statewide issue. Representative Deutsch offered to meet with the LRC personnel to ask if an amendment could be drafted to remove liability exposure for the county. Chairman Mach thanked everyone for the good discussion and asked the legislators to keep in touch during the session.
Sheriff: Kevin Owen reported the engine in the 2015 Tahoe had blown up. The 2021 budget has funding for replacing one vehicle, but now with the Tahoe out of service, he is requesting approval to order two police vehicles. Beck Motors in Pierre has the State bid for a Chevrolet Silverado pickup at a base price of $29,574. with the addition of a receiver hitch, tire upgrade and red/white flashing lights the cost would be $30,654 times two. The purchase order would need to be signed today as no additional orders are being done after January 1st. The additional funding will be out of the contingency budget or a budget supplement will need to be done in 2021. Motion by Tostenson and seconded by Stengel to approve the purchase of two 2021 Chevy Silverado trucks from Beck Motors. Chairman Mach called for a roll call vote. Buttke aye, Street aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0.
Motion by Stengel and seconded by Buttke to declare surplus the 2015 Tahoe and the 2014 Dodge Durango. Chairman Mach called for a roll call vote. Buttke aye, Street aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0. Motion by Street and seconded by Stengel to sell the Durango and Tahoe by sealed bids on February 2, 2021. Chairman Mach called for a roll call vote. Buttke aye, Street aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 5-0.
Commissioner Buttke excused himself from the meeting at 10:35 AM.
Executive Session: Motion by Stengel and seconded by Street to enter executive session at 10:40 AM for the purpose of a personnel(s) issue pursuant to SDCL 1-25-2 (1). Chairman Mach called for a roll call vote. Street aye, Stengel aye, Tostenson aye and Mach aye. Motion carried 4-0. Auditor Layher, John Madsen, Angela Beacom and Brett Dickerson were present. Chairman Mach declared the meeting open to the public at 11:45 AM. No action taken because of the executive session.
Commissioner Stengel excused himself from the meeting.
Recess: Motion by Tostenson and seconded by Stengel to recess for lunch at 11:45 AM. Chairman Mach called for a roll call vote. Street aye, Buttke aye, Tostenson aye and Mach aye. Motion carried 4-0. Chairman Mach reconvened the Board of Commissioners at 12:45 PM with Commissioners Buttke, Street, Tostenson and Mach.
2021 Holidays: Motion by Street and seconded by Buttke to approve the 2021 holiday schedule as presented. Chairman Mach called for a roll call vote. Street aye, Buttke aye, Tostenson aye and Mach aye. Motion carried 4-0.
Boards: Motion by Street and seconded by Tostenson to increase the pay rate from $25 to $50 per meeting for the Visiting Neighbor Board, Library Board and Weed Board beginning in 2021. Chairman Mach called for a roll call vote. Street aye, Buttke aye, Tostenson aye and Mach aye. Motion carried and resolution adopted 4-0.
2021 Salary Resolution: Motion by Street and seconded by Buttke to approve a cost-of-living increase of 3% for employees with an additional adjustment to the base of 50 cents for employees and a $1.00 per hour for designated department personnel. Chairman Mach called for a roll call vote. Street aye, Buttke aye, Tostenson aye and Mach aye. Motion carried and resolution adopted 4-0.
